General Terms and Conditions

for events of the Talentcenter of the Styrian Economic Chamber

 

  1. Scope

These General Terms and Conditions apply to paid events offered by the Talentcenter of the Styrian Economic Chamber (hereinafter referred to as Talentcenter). By submitting a registration, the participant expressly agrees to these General Terms and Conditions and is bound by them. Any deviating agreements must be made in writing in order for them to be valid.

  1. Registration guidelines

We have a limited number of participants for our events, so places are reserved in the order, in which registrations are received. If you do not show up on the first day of the event, we may give your place to another interested person. The registration deadline is stated in the registration documents. Subject to free places and a quick processing of a necessary preliminary survey from home (if part of the event), registration is also possible after this deadline. Registration can be made not only in writing, but also orally and by telephone, as well as online, by fax and/or e-mail, and only becomes legally binding upon confirmation, which is sent by e-mail.

  1. Terms of payment

Please transfer the participation fee immediately after receipt of the invoice. In the event that payment deadlines are missed, we reserve the right, apart from the possibility of legal action, to assert our claims out of court through a lawyer or a collection agency. We are entitled to charge the costs necessary and reasonable for the appropriate legal prosecution.

  1. Cancellation of participation

In the event that you are unable to attend, you must cancel in writing. This is free of charge until the respective registration deadline. After the registration deadline, a cancellation fee of 50 percent of the participation fee is due. If you cancel on the first day of the event or afterwards, or if you do not show up, we will have to charge you the full event fee. You can, of course, nominate a substitute participant, who fits into the target group of the event. However, the original participant remains liable for the course fees.
Attention: these cancellation conditions also apply in case of illness!

  1. Right of withdrawal as a private customer in distance selling transactions

If the booking of an event is made via distance selling, i.e. in particular by telephone, fax, e-mail or Internet, the participant, as a consumer within the meaning of the Consumer Protection Act (KSchG), has a statutory right of withdrawal within the meaning of the Austrian Long Distance and Remote Sales Act (FAGG) within 14 calendar days from the conclusion of the contract. This does not apply to events that already begin within these 14 calendar days from the conclusion of the contract. The withdrawal period shall be deemed to have been observed if the declaration of withdrawal is sent within the period. You can therefore withdraw from the contract within 14 calendar days of the conclusion of the contract without giving reasons by sending a written declaration of withdrawal (e.g. letter, fax, e-mail). It is sufficient if the declaration of withdrawal is sent within this period (the date of the postmark is decisive). Saturdays, Sundays and public holidays count. In addition to the above provisions, you have the option of declaring your withdrawal in person at the Talentcenter, during office hours (Mon to Thurs 08:00 to 16:00, Fri 08:00 to 14:00), within the withdrawal period. The conditions for withdrawal in these GTC apply.

If you withdraw from this contract, we must repay you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day, on which we received the notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.

If you have requested that the services begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you notify us of the exercise of the right of withdrawal in respect of this contract compared to the total scope of the services provided for in the contract.

  1. Changes to the programme of events

Many Talentcenter events are planned over a longer period of time. For organisational reasons, there are sometimes changes to the programme in the course of this time. It is also possible that the minimum number of participants for an event is not reached and that the event therefore does not take place. The Talentcenter reserves the right to make changes to course days, starting times, dates, venues, trainers and event cancellations. Should this be the case for an event booked by you, we will inform you in good time and in an appropriate manner. In case of event cancellations, any participation fees already paid will be refunded without deduction.
No claims for compensation for expenses incurred or other claims against the Talentcenter can be derived from event changes or cancellations.

  1. Withdrawal from the contract

In order to ensure that the objectives of the event are achieved, the Talentcenter may exclude participants with insufficient previous qualifications or participants, whose behaviour negatively affects the course of the event from participation.

  1. Barrier-free access

We provide barrier-free access to our public events for people with special needs. Should you require assistance in this regard, we request that you contact customer service in good time before the start of the event.

It is pointed out that the implementation of the Talentcheck for the target group of 13 to 15 year olds with a physical limitation is only partially feasible and does not include an automated evaluation of results.

  1. Bringing animals

Animals (especially dogs) are not allowed.

  1. Copyright

The Talentcenter remains the owner of the property rights and copyrights existing at the time of the event. No part of the documents and other media created by the Talentcenter before, during or after the respective event may be reproduced, processed, duplicated, distributed or used for public reproduction without permission. Insofar as documents or other media, to which third parties have rights, are used in the processing of the order, these rights will remain with the respective copyright holder.

  1. Things to know about photographs and video recordings

At events, the Talentcenter may take photographs or video recordings that depict the participant. The legal basis for this is the legitimate interest as defined in art. 6 para. 1 lit f GDPR and §§ 12, 13 DSG [Data Protection Act]: public relations work and presentation of the activities of the responsible party in order to increase the level of awareness of the responsible party.

There is a right to object to the processing. The objection can be addressed to office@talentcenter.at (although any other type of objection is also possible).

If the rights and freedoms of a person depicted are violated for reasons that are particularly worthy of consideration, we will take appropriate measures to refrain from further processing. Unidentification in print media that have already been issued cannot take place. Deletion on the website or in social media channels will take place within the scope of technical possibilities.

  1. Liability

In cases of slight negligence, the Talentcenter and its employees, contractors or other vicarious agents will not be liable for material or financial damage to the client, irrespective of whether this relates to direct or indirect damage, lost profit or consequential damage, damage due to delay, impossibility, positive breach of contract, culpa in contrahendo, defective or incomplete performance. Insofar as the liability of the Talentcenter is excluded or limited, this also applies to the personal liability of its employees.

No liability claims can be made against the Talentcenter for the application of the knowledge acquired in the Talentcenter or for the correctness and up-to-dateness of the content of the documents, articles or slide sets provided. The Talentcenter accepts no liability for printing or typographical errors in its publications and web pages.

In the course of the Talentcheck for the target group of 13- to 15-year-olds, automated result feedback is generated, which is carried out with the usual scientific care and in compliance with the recognised rules of science and technology. The Talentcenter cannot accept any liability for the correctness and completeness of the content of the results feedback.

  1. Data protection

Personal data provided by clients electronically, by telephone, verbally, by fax or in writing is stored and used for quality assurance purposes. For detailed information on data protection, please refer to our data protection information on the website www.talentcenter.at, the provisions of which apply.

  1. Jurisdiction and applicable law

Austrian law will apply. If it is not a consumer transaction within the meaning of the KSchG, the place of jurisdiction is Graz. In case of consumer transactions, the statutory provisions will apply.
